By accessing or using InstaView at getinstaview.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not use the Service.

These Terms apply to all users of the Service. We may update these Terms at any time (see Section 11). Your continued use of the Service after any changes constitutes acceptance of the new Terms.

InstaView is a free, browser-based toolkit that retrieves and displays publicly available Instagram profile data, including posts, stories, highlights, follower counts, and engagement metrics. The Service does not require you to log in to Instagram or provide any Instagram credentials.

InstaView is an independent service and is not affiliated with, endorsed by, or sponsored by Instagram or Meta Platforms, Inc. in any way.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

Subject to these Terms, you may use the Service to:

• View publicly available Instagram profile information for research, personal use, or journalism
• Download publicly available media that you have the right to access
• Analyse engagement and growth metrics for accounts you own or manage
• Compare public account statistics
• Use AI-powered tools (captions, hashtags, fonts) for your own content creation

You must not use the Service to:

• Stalk or harass individuals — monitoring a person's activity, location, or social connections without their consent
• Collect or aggregate personal data at scale for commercial databases, lead generation, or data brokering
• Violate Instagram's Terms of Service or Community Guidelines
• Infringe intellectual property rights — downloading or redistributing content without the rights holder's permission
• Circumvent rate limits or access controls through bots, scrapers, or automated tools
• Engage in unlawful activities including but not limited to fraud, identity theft, or privacy violations
• Access or attempt to access private Instagram accounts
• Harm minors in any way
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the Service or its infrastructure

InstaView content: The Service's design, code, branding, and original content are owned by InstaView and protected by copyright. You may not reproduce, distribute, or create derivative works without our written permission.

Instagram content: All Instagram content displayed through the Service (photos, videos, profiles, bios) belongs to the respective content creators and/or Meta Platforms, Inc. InstaView does not claim any ownership over this content.

Your responsibility: You are solely responsible for ensuring you have the right to download, use, or distribute any content you access through the Service. Downloading content for personal viewing is generally permissible; redistribution or commercial use requires the rights holder's permission.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. We do not guarantee the accuracy, completeness, or timeliness of any data retrieved from Instagram. Instagram data is fetched live and may be delayed, incomplete, or unavailable.

We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INSTAVIEW AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (OR $10 IF YOU HAVE NOT MADE ANY PAYMENTS).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages. In such jurisdictions our liability is limited to the greatest extent permitted by law.

You agree to indemnify, defend, and hold harmless InstaView and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the Service in violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any third-party rights, including intellectual property rights

We may suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms, is harmful to other users, us, third parties, or for any other reason at our sole discretion.

Upon termination, all provisions of these Terms that by their nature should survive will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

We reserve the right to modify these Terms at any time. We will indicate the date of the most recent update at the top of this page. For material changes, we may display a prominent notice on the homepage.

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree, stop using the Service.
